Patrice Miller has extensive experience managing complex Superfund enforcement cases and in the collection, management and organization of large amounts of information during the pre-litigation, trial preparation and trial support phases of an enforcement matter.  Ms. Miller was instrumental in the development of the first protocol in EPA Region 6 to ensure compliance with the Federal Rules of Civil Procedure for Electronic Discovery and is certified by the Association of Certified E-Discovery Specialists (ACEDS) as an “Electronic Discovery Specialist.”

Ms. Miller is a former Senior Enforcement Officer in the Office of Regional Counsel, Criminal Enforcement Unit, with the U. S. EPA Region 6 office in Dallas, Texas where she specialized in case management and electronic data management  in the RCRA and CERCLA enforcement programs.  Among her many accomplishments was the development of an electronic resources program to capture and organize workload information for attorneys. Additionally, she developed and managed an electronic index program to track discovery materials related to legal productions, responses and trial.  During her career at EPA, Ms. Miller also served as a Senior Enforcement Officer in the Superfund Cost Recovery Section where her duties included finding PRPs, investigating cost recovery issues, negotiating for settlement, preparing liability and cost recovery cases, and developing referrals to the U. S. Department of Justice.  She has served as a fact witness, providing declarations and oral testimony, both in deposition and at trial.

Ms. Miller provides assistance to counsel with multimedia records: from identification to collection, organization, review and management.  She develops analytic approaches and protocols for electronic discovery processes, creates defensible e-discovery process documentation, and can assist counsel with preparation for meet and confer Rule 26 discovery negotiations. Having extensive experience in trial preparation and support, Ms. Miller assists counsel at every phase of litigation.  She can provide testimony regarding records consulting and all aspects of her trial support. In addition, she assists with the preparation of responses to requests for information, subpoenas, interrogatories and requests for production. Ms. Miller, through document review and witness interviews, investigates facility operational history, past environmental practices, regulatory history, and corporate succession.  Among her specialties is development of protocols for the creation of waste-in lists, often the foundation for Superfund liability cost allocations.
